In 2006, the first series of high-profile child deaths associated with powered gates occurred, followed by the watershed moment in 2010 when two children died in separate powered gate incidents in the same week. It would be entirely fair to say that, since then, there has been a huge change in perceptions and understanding of the rules, standards, and culture of the industry.

In 2014, the Health and Safety at Work Act was breached by two companies linked to a child death incident in 2010. Interestingly, the companies prosecuted were not the original installers but those responsible for the gate’s repair and maintenance since installation. As a result, those involved in the repair and maintenance of powered gates are now highly sensitive to the safety of the systems they work on. Since 2010, the industry has gradually improved its understanding of safety regulations. However, there are still many unsafe gates in operation today, and maintenance and repair companies are informing owners of any safety issues they encounter.

Our gate systems are installed to a high standard, with safety devices such as photocells and resistive rubber edges fitted in the correct areas. These work alongside automation equipment that usually has anti-crush obstacle detection systems built into the drive units. We conduct force tests and provide pass results to ensure your new gate system operates safely.

Gate Safety Responsibility

At no point should the owner and contractor attempt to enter into an agreement that transfers the contractor’s responsibility to the owner. It is not possible under UK law to transfer a criminal responsibility from one party to another by means of civil contract. This could be seen by investigation authorities as colluding with the other to maintain an unsafe situation.

As a result, if an owner refuses to have an unsafe gate made safe, then it could be that the contractor may have no other option than to exit the contract. If the result is an unsafe gate remaining in service, then the HSE see this as an unacceptable situation.
